1. Agreement to these Terms
These Terms of Service govern access to and use of Kommon Poll, including the website, web application, dashboards, searches, tracking credits, alerts, reports, exports, integrations, support tools, documentation, and AI-assisted features.
Kommon Poll is an AI-powered social listening and brand intelligence platform that helps teams monitor public conversations, understand sentiment and intent, detect reputation risks, compare competitors, and turn multilingual online signals into decisions.
By creating an account, using the Service, clicking to accept these Terms, signing an Order Form, or using any pilot, free, paid, or custom plan, you agree to these Terms on behalf of yourself or the organisation you represent.
2. Definitions
In these Terms:
- Company, we, us, or our means Synapse Artificial Intelligence Labs (Pvt) Ltd, trading through or providing the Kommon Poll product.
- Service means Kommon Poll and all related websites, applications, dashboards, APIs, reports, alerts, integrations, customer support, documentation, and professional services.
- Customer, you, or your means the individual or organisation using the Service.
- Authorised User means a person invited or permitted to use the Service under your account.
- Customer Data means data, search terms, tracking links, keywords, competitors, uploaded files, prompts, account settings, reports, notes, comments, and other content submitted to or configured in the Service by or for you.
- Public Source Data means publicly available or third-party source content collected, indexed, analysed, enriched, or displayed by the Service, such as social media content, reviews, forum posts, news, blogs, public pages, public profiles, public comments, public engagement metrics, and other online mentions.
- Kommon Poll AI means AI-assisted functionality that summarises, classifies, clusters, translates, ranks, recommends, drafts, or otherwise analyses data and outputs.
- Order Form means any signed proposal, quotation, invoice, checkout page, statement of work, subscription confirmation, pilot agreement, or other commercial document that describes the plan, fees, limits, features, and term of access.
3. Accounts and authorised users
You must provide accurate account, organisation, billing, and contact information and keep it updated. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
You are responsible for your Authorised Users, including their access levels, permissions, use of exports and reports, and compliance with these Terms. You must promptly remove users who no longer require access.
Notify us immediately if you suspect unauthorised access, credential compromise, or misuse of the Service.
4. Plans, access, and product limits
Kommon Poll may offer free, starter, growth, pro, custom, pilot, enterprise, agency, campaign, crisis, competitor, and other plans. Plan names, features, data coverage, pricing, mention limits, search limits, tracking credits, refresh rates, report availability, support levels, integrations, and user limits may differ by plan and may change from time to time.
The specific access rights for your account are determined by the applicable Order Form, checkout flow, customer dashboard, or written agreement. Marketing pages and help documents explain the Service generally, but they do not override the commercial terms agreed with you.
We may make changes to improve security, comply with law, respond to third-party platform changes, prevent misuse, update product functionality, or maintain the Service.
5. Fees, billing, renewals, and failed payments
Fees are payable as described in your Order Form, invoice, checkout page, or subscription confirmation. Fees may be charged monthly, annually, by project, by search, by mention volume, by tracking credit, by report, by user, by support level, or by another agreed commercial model.
- Trials and free plans: Free or trial access may have limited searches, sources, mentions, reports, support, refresh rates, or retention. We may change, restrict, or end free or trial access.
- Renewals: Subscription plans may renew automatically unless cancelled as required by the applicable Order Form or checkout terms.
- Taxes and charges: Unless stated otherwise, fees exclude taxes, bank charges, payment gateway fees, withholding tax, duties, and levies.
- Failed or late payment: We may suspend or restrict access, pause data collection, withhold reports, or terminate the account if payment fails, invoices become overdue, or usage exceeds agreed limits.
- Plan changes: Upgrades, extra users, added searches, increased mention limits, additional tracking credits, urgent monitoring, custom reports, integrations, or implementation may result in additional charges.
Payment obligations are non-cancellable and non-refundable except as expressly stated in the applicable Order Form, the Refund Policy, or applicable law.
6. Acceptable use
Your use of the Service must also comply with our Acceptable Use Policy, which forms part of these Terms. If there is a conflict, these Terms and the more specific restriction will apply.
You must use Kommon Poll lawfully, responsibly, and in a way that respects third-party rights and platform rules. You must not:
- use the Service to violate law, regulation, contractual restrictions, platform terms, privacy rights, intellectual property rights, or other third-party rights;
- attempt to access accounts, systems, APIs, datasets, tracking links, integrations, or information that you are not authorised to access;
- use the Service for harassment, doxxing, unlawful surveillance, discriminatory profiling, stalking, individual targeting, or harmful conduct;
- submit searches, tracking links, keywords, files, prompts, or data that you are not authorised to process;
- upload malware, harmful code, unlawful content, or content that infringes third-party rights;
- reverse engineer, decompile, scrape, crawl, overload, interfere with, or benchmark the Service for competitive purposes except as permitted by law or written agreement;
- misrepresent Kommon Poll outputs, reports, dashboards, screenshots, recommendations, or AI-generated content as guaranteed, complete, official, or endorsed where this is not true;
- use outputs as the sole basis for legal, medical, financial, employment, credit, insurance, or similarly significant decisions about individuals; or
- remove notices, watermarks, disclaimers, attribution, source references, or usage restrictions from reports or exports where those are required.
We may investigate suspected misuse and may suspend, restrict, or terminate access where we reasonably believe use of the Service creates legal, security, platform, operational, or reputational risk.
7. Customer Data, Public Source Data, and AI outputs
You retain ownership of Customer Data. You grant us a limited licence to host, process, copy, transmit, analyse, store, display, transform, and use Customer Data as necessary to provide, secure, support, troubleshoot, maintain, and improve the Service, comply with law, and enforce these Terms.
Kommon Poll may collect, monitor, enrich, classify, deduplicate, translate, cluster, summarise, and report on Public Source Data and other sources configured in your account. Coverage may include public social networks, public pages, public groups where available, news, blogs, forums, reviews, app stores, travel sites, public channels, and other online sources, depending on the plan and source availability.
Public Source Data may be incomplete, delayed, rate-limited, duplicated, removed, inaccurate, unavailable, or affected by changes to third-party platforms, search indexes, APIs, permissions, privacy settings, regional restrictions, moderation decisions, or source quality.
Kommon Poll AI may generate summaries, themes, sentiment labels, intent labels, topics, recommendations, rankings, translations, alerts, and report narratives. AI outputs may be inaccurate, incomplete, duplicated, or contextually wrong. You are responsible for reviewing outputs before relying on them, publishing them, sending them to clients, or using them in decisions.
8. Third-party platforms, sources, and integrations
The Service may interoperate with or depend on third-party platforms, sources, APIs, search engines, hosting providers, payment processors, analytics services, email tools, messaging tools, support widgets, calendar links, documentation sites, product-feedback tools, and other services.
Third-party services are not controlled by us. We are not responsible for their availability, data quality, API rules, pricing, security incidents, policy changes, content decisions, or platform restrictions. If a third-party service changes or stops supporting access, some Kommon Poll features may become unavailable, delayed, limited, or modified.
You are responsible for ensuring that you have the required rights, permissions, licences, consents, notices, and lawful basis to connect third-party accounts, pages, profiles, groups, hashtags, channels, dashboards, or integrations to Kommon Poll.
9. Privacy and data protection
Our Privacy Policy explains how we collect, use, disclose, and protect personal data. Our Cookie Policy explains how our website and product may use cookies and similar technologies. Where we process Customer Data as a processor or service provider, the Data Processing Agreement may apply.
You are responsible for determining whether your use of Kommon Poll requires notices, consents, legitimate-interest assessments, data protection impact assessments, contractual terms with your own customers, retention controls, access restrictions, or other safeguards.
If you use the Service in a regulated sector, for sensitive monitoring, or for cross-border reporting, you must ensure your configuration and use comply with applicable law and internal governance policies.
10. Confidentiality
Each party may receive non-public information from the other party, including product information, pricing, technical information, account configurations, reports, credentials, business information, and customer information. The receiving party must protect confidential information using reasonable care and use it only for the purpose of the relationship.
Confidentiality obligations do not apply to information that is publicly available without breach, independently developed without use of confidential information, lawfully received from a third party, or required to be disclosed by law.
11. Intellectual property and brand use
We and our licensors own all rights in the Service, including software, workflows, dashboards, interface designs, data models, analytics methods, documentation, templates, report formats, product names, logos, marks, and brand assets. Except for the limited right to use the Service under these Terms, no rights are transferred to you.
You may use Kommon Poll reports and exports for your internal business purposes and for client or stakeholder reporting where your plan or Order Form permits it. You must not remove required notices, misstate the source of the analysis, or imply that Kommon Poll endorses your conclusions unless agreed in writing.
Use of the Kommon Poll name, logo, icon, screenshots, reports, or other brand assets must follow the Kommon Poll brand guidelines. You may not use Kommon Poll marks in a way that implies ownership, endorsement, certification, sponsorship, or partnership unless approved in writing.
12. Feedback and product improvement
If you provide feedback, ideas, bug reports, product requests, or suggestions, you grant us a perpetual, worldwide, royalty-free right to use them to improve Kommon Poll and related services without restriction or compensation. We will not disclose your confidential information simply because it was included in feedback.
13. Suspension and termination
We may suspend, restrict, or terminate your access if you breach these Terms, fail to pay fees, create legal or security risk, misuse the Service, exceed agreed limits, violate platform rules, or if we are required to do so by law or a third-party provider.
You may stop using the Service at any time. Cancellation and non-renewal rights depend on your Order Form, checkout terms, invoice terms, or written agreement. Termination does not relieve you of payment obligations incurred before termination.
After termination, we may delete or disable access to Customer Data in accordance with our retention practices, the applicable Order Form, the DPA, and legal requirements.
14. Disclaimers
The Service is provided on an "as is" and "as available" basis to the maximum extent permitted by law. We do not guarantee uninterrupted operation, complete source coverage, real-time delivery for every source, perfect sentiment analysis, perfect deduplication, error-free reports, complete historical data, or that every relevant mention, post, review, or conversation will be captured.
Insights, alerts, recommendations, summaries, and AI outputs are decision-support tools. They are not legal, financial, reputational, public-relations, medical, psychological, investment, or professional advice.
We do not control third-party public content, user-generated content, platform availability, public sentiment, customer complaints, competitor activity, public-source takedowns, or platform moderation outcomes.
15. Limitation of liability
To the maximum extent permitted by law, neither party will be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost goodwill, loss of data, business interruption, loss of opportunity, reputational harm, or costs of substitute services, even if advised of the possibility of such damages.
Unless a separate written agreement states otherwise, our aggregate liability arising out of or relating to the Service will not exceed the fees paid by you for the affected Service during the three months before the event giving rise to the claim.
Nothing in these Terms excludes or limits liability where such exclusion or limitation is not permitted by applicable law.
16. Indemnity
You agree to defend, indemnify, and hold harmless the Company, its affiliates, officers, directors, employees, contractors, and agents from claims, losses, liabilities, damages, penalties, costs, and expenses arising from your Customer Data, your use of the Service, your breach of these Terms, your violation of law or third-party rights, your unauthorised use of third-party platforms or integrations, or your publication or external use of Kommon Poll outputs.
17. Governing law and disputes
These Terms are governed by the laws of Sri Lanka, without regard to conflict-of-law rules. The parties will first attempt to resolve disputes in good faith through written notice and reasonable discussions.
If a dispute cannot be resolved informally, the parties submit to the exclusive jurisdiction of the competent courts of Colombo, Sri Lanka, unless another forum is required by applicable law or a separate written agreement.
18. Changes to these Terms
We may update these Terms from time to time. The updated version will be posted on this page with a new Last updated date. If we make material changes, we may provide additional notice by email, in-app notice, account notice, or another reasonable method.
Your continued use of the Service after an update becomes effective means you accept the updated Terms. If you do not agree to the updated Terms, you must stop using the Service.
